1. General Conditions / Scope of Application
The following standard contract terms shall apply to all deliveries, offers and other services of Laufsport Heinz. Counter-confirmations of the customer with reference to its own standard or sales terms and conditions are hereby objected to. Any deviations to these standard terms shall only be effective if Laufsport Heinz has confirmed such deviations in writing.

2. Entering of Sales Contract via our Online-Shop
When you place an order with Laufsport Heinz via our Online-Shop, your order constitutes an offer to us to enter into a sales contract with you. Immediately upon our receipt of your order you will receive an automatically generated acknowledgement of receipt of your order by email. Such acknowledgement of receipt does not constitute the acceptance of your offer by Laufsport Heinz. We shall accept your offer only by sending you via email an PDF invoice covering the ordered goods. As regards goods contained in your order which are not contained in our invoice e.g. because in an individual case such goods are no longer available at that point in time, no sales contract is concluded.

3. Sales Prices
The prices listed in the Online-Shop are including the at the moment valid value added tax (VAT).
Customers from countries outside the European Union shall be exempt from German VAT.
Only the prices and offers are valid stated in our Online-Shop on the day of ordering.
At obvious faults on the web site or in this one from the web site downloadable electronic documents e.g. we are entitled to the resignation rake or misprints.

4. Shipping Costs (see also Online-Help)

» Within Germany and Switzerland:
For orders below 50,- € the shipping costs are 5,- €. Orders with value of goods > 50,- € are free of shipping costs.

5. Delivery ~~(see also Online-Help)~~
· There is no minimum order quantity.
· The order will be processed with 1 workday.
You will receive the final invoice per mail on the same day if all products in stock.
In case of a product is not in stock we will place an inquiry at the supplier on the same day.
The customer will be informed about the final availability and delivery date on the subsequent workday.
As soon al products will be available for shipping and the money has been transferred in case of prepayment,
the goods will be shipped on the same or latest on the subsequent workday.
· Problems caused by acts of nature, technical problems, material defects or delays caused by our suppliers like import or export
restrictions will extend the delivery date by the duration of such a obstruction.
We will immediately inform our customers about such delays.
· We reserve the right to make partial deliveries in order to facilitate quick order processing.

6. Terms of Payment ~~(see also Online-Help)~~
· You can either pay per prepayment, C.O.D., PayPal or Credit Card

· The C.O.D. charge for Germany is 8.- €.
· For prepayment we grant following discount (also on Specials):
   - Value of goods > 100 € 5%
   - Value of goods > 300 € 7,5%
   - Value of goods > 500 € 10%
· The customer receives by email an invoice in PDF format prior to the shipment (please do not pay before).
· Credit Card payment by the "pre-auth"-method (authorization and reservation). Debit (capture) after acceptance of the final PDF invoice by the customer, therefore no prepayment discount is granted. Authorization expires automatically after 28 days.

7. Damages in Transit
Loss or damage during transport must be reported immediately to the carrier (Post, DHL, UPS, etc.). Any damage must be certified by the carrier before handing over the goods.
If any damage is found despite the packaging being intact, this must be reported immediately. Complaints relating to recognizable manufacturing defects or external damage to the product must be made in writing within 14 days of receipt of the goods, by hidden defects immediately upon discovery. The goods must be returned carriage paid with a detailed description of the problem.

8. Notice of defect/Exchange/Return
We assure the return unused products within 14 days.
On receipt, the customer must examine the goods immediately for signs of defects and to ensure that they have the requisite properties. In the event of obvious defects, they must be reported to us immediately in writing, whilst concealed defects must be reported in the same way as soon as they are discovered. Otherwise the warranty for these defects shall be invalidated.
In the case of a practice of the revocation the customer bears the costs of the return unless that the delivered product does not correspond to the ordered product.

9. Guarantee
Apart from the 14 days conversion rights we concede the legal guarantee claims.
The warranty period shall be 24 months from the date of delivery. In the event of complaints, the date of purchase must be verified by the presentation of an invoice. The concerned article of complaint must be returned to the vendor together with a copy of the invoice, sufficiently stamped and including the completed return form.
The warranty does not cover normal wear and tear. The warranty shall be invalidated if the customer makes any changes to the supplied goods.
Laufsport Heinz shall be entitled to refinish the goods free of charge during the warranty period. The partial or complete replacement of the article is also possible. If defects are not rectified within a reasonable period of time, the purchaser shall be entitled to cancel the contract or demand a reduction. § 476a of the German Civil Code is applicable.
The refund is carried out on a bank account of the customer or internal in a credit note.

10. Reservation of title
We reserve the property for us at the delivery items until the payment. At behavior of the customer particularly at delay in payment contrary to the terms of the contract we are entitled to the repurchase after reminder and the customer commits to doing the handing out.

11. Privacy
We use your personal information only for the completion of transactions. All customer information is stored and processed according to the relevant guidelines of the German Federal Privacy Protection Law (Bundesdatenschutzgesetz, BDSG) and the Teleservice Privacy Protection Law (Teledienstdatenschutzgesetz, TDDSG).
You have the right at any time and without cost to access, correction, closing or deletion of personal information. To do this, please contact us via mail or fax.
We will not give your information, including address and email address, to a third party without your express permission, which you can revoke at any time. This does not include our service partners who require the information in order to complete transactions (e.g. the shipping company contracted to delivers the goods and the financial institution processing payment).

In these cases the information shared is limited to the minimum information necessary.

To protect your information payment data is transferred encoded (SSL 256-bit encryption).

12. Place of performance of jurisdiction
Place of performance and jurisdiction, to the extent a choice is permitted by laws, is Lörrach (Germany).
Exclusively the German law is valid.
